Acceptance of Terms
By accessing the Bullwhip Logistics website, using our Customer Portal, or booking our courier, freight, 3PL, or warehousing services, you agree to be bound by these Terms and Conditions.
Use of the Customer Portal
Customers provided with access to our Transportation Management System (TMS) Portal are responsible for maintaining the confidentiality of their login credentials. You are responsible for all activity, including freight bookings and label generation, that occurs under your account.
Service Obligations & Accuracy of Information
When booking a shipment (whether local courier or North American freight), the user must provide accurate weights, dimensions, and commodity descriptions. Bullwhip Logistics reserves the right to adjust billing if the actual freight differs from the provided dimensions/weight. Users must not ship illegal, hazardous, or restricted materials without prior written disclosure and legal authorization.
Limitations of Liability & Transit Times
While Bullwhip Logistics prides itself on reliable, daily routes (especially our Eastern Manitoba service), all transit times are estimates. We are not liable for delays or damages caused by factors outside our control, including but not limited to:
- Severe weather conditions or “Acts of God” (e.g., Manitoba winter storms, highway closures).
- Delays at international borders or customs holds.
- Actions or omissions by the shipper or receiver. Note: Specific liability limits for damaged or lost freight are governed by the specific Bill of Lading (BOL) issued for each shipment.
Warehousing Terms
Goods stored in our Winnipeg warehousing facility are held under standard warehouse receipt terms. Bullwhip Logistics is not liable for inventory degradation due to the inherent nature of the goods unless caused by our direct negligence.
Governing Law
These terms are governed by the laws of the Province of Manitoba and the federal laws of Canada applicable therein.
